Terms of Service

These Terms of Service ("Terms") are an agreement between you and CHEESE LLC ("we", "us" or "our"), the operator of Recipe Cheese. They cover your use of our website, recipes, membership and online shop. Please read them carefully, especially the sections on membership renewal, limitation of liability and governing law.

1. Acceptance of these Terms

By visiting the site, creating an account, starting a free trial, buying a membership or placing an order, you agree to these Terms and to our Privacy Policy, Cookie Policy, Refunds & Money-Back Guarantee and Disclaimer, which are part of these Terms. If you do not agree, please do not use the site.

You must be at least 18 years old, or the age of majority where you live, to create an account, buy a membership or place an order. If you use the site on behalf of a business, you confirm you are authorized to accept these Terms for it.

2. Accounts

• Give accurate information when you register and keep your name and email address up to date.
• Keep your password confidential. You are responsible for activity under your account unless it results from our own failure to protect it.
• Tell us promptly at info@recipecheese.com if you suspect unauthorized use.
• Accounts are personal. Do not share your login or resell access to membership content.

You may close your account at any time by contacting us. We may suspend or close an account that breaks these Terms, is used for fraud, or puts other users or the site at risk. If we close your account without cause, we will refund any unused prepaid membership time.

3. Membership, free trial and renewal

What membership includes

About 50 percent of our recipes are free for everyone. A membership unlocks the rest of the recipe library and member features for as long as your membership is active. We regularly add, update and occasionally retire recipes and features.

Plans and prices

• Monthly plan: $9.99 per month.
• Annual plan: $99.99 per year.

Prices are in USD and do not include any sales tax that may apply where you live.

Free trial

New members may start a 30-day free trial. You will be asked for a payment card when the trial starts, but you will not be charged during the trial. Unless you cancel before the trial ends, your membership automatically converts to a paid membership and your card is charged the full price of the plan you chose ($9.99 for monthly or $99.99 for annual) on the day the trial ends. Free trials are limited to one per person and household.

Automatic renewal

Paid memberships renew automatically at the end of each billing period (every month for the monthly plan, every year for the annual plan) and your card is charged the plan price then in effect, until you cancel. By starting a trial or membership, you authorize us to charge your payment card on that recurring basis. If we change a plan price, we will tell you in advance and the new price will apply from your next renewal after the notice. If a charge fails, we may retry it or pause your membership until the payment details are updated.

Cancellation

You can cancel anytime from your account page, or by emailing info@recipecheese.com. There are no cancellation fees.

• If you cancel during the free trial, you will not be charged at all.
• If you cancel a paid membership, it will not renew again and you keep member access until the end of the period you have already paid for.
• You can also ask for a full refund of your most recent membership charge within 30 days of that charge under our money-back guarantee.

4. Shop orders

Our shop sells Recipe Cheese house-brand kitchen accessories. When you place an order, you are making an offer to buy the items in your cart. We accept the offer when we ship the items. An order confirmation page means we received your order, not that it has been accepted.

We may refuse or cancel an order, for example if an item is out of stock, if there is an error in price or description, or if we suspect fraud. If we cancel an order after you were charged, we will refund the full amount. We may limit quantities per customer.

You agree that the payment information you provide is yours or that you are authorized to use it, and that you will pay all charges at the prices in effect when the order is placed, plus applicable shipping and taxes.

5. Pricing and availability

We work to show accurate prices, descriptions, photos and stock levels, but mistakes can happen. Colors may look slightly different on your screen, and product dimensions may vary slightly from what is listed. If we find a pricing error on an item you ordered, we will contact you and let you choose to proceed at the correct price or cancel for a full refund. Prices and availability may change without notice, but changes will not affect orders we have already accepted.

6. Shipping

• We ship shop orders to addresses within the United States only.
• Shipping is free on orders of $75.00 or more (before taxes). Orders under that amount have a flat shipping rate of $6.99.
• Delivery estimates are estimates, not guarantees. We are not responsible for carrier delays outside our control, but we will help you track down a late package.
• Title and risk of loss pass to you when the carrier delivers your order. If a package is lost in transit or arrives damaged, contact us and we will send a replacement or a refund.
• Please check your shipping address carefully. If a package is returned because of an incorrect address, we will reship it or refund the order once it comes back to us.

7. Refunds

Both memberships and shop orders are covered by our 30-day money-back guarantee. The details are in our Refunds & Money-Back Guarantee, which is part of these Terms.

8. Intellectual property

The site and its content, including recipes, recipe text and instructions, photographs, videos, illustrations, the Recipe Cheese name and logo, product designs and the design of the site itself, are owned by or licensed to CHEESE LLC and are protected by copyright, trademark and other laws.

We give you a limited, personal, non-exclusive, non-transferable license to view the site, print or save recipes for your own home cooking, and share links to our pages. You may not, without our written permission:

• copy, republish, sell or distribute our recipes or photos, in whole or in substantial part, on other websites, in apps, cookbooks, social posts or other media;
• remove copyright or other notices;
• scrape, crawl or bulk download content, or use it to build a database or train software systems;
• share or make member-only content available to people who are not members;
• use our name or logo in a way that suggests we endorse you or your products.

Ingredient lists and basic cooking methods are not something anyone can own, and you are welcome to cook, adapt and talk about our recipes. We simply ask that you credit Recipe Cheese and link to the original page rather than copy our written instructions and photos.

If you send us feedback, suggestions or recipe ideas, you allow us to use them without payment or obligation to you.

9. User conduct

When using the site you agree not to:

• break any law or infringe anyone else's rights;
• send spam, harassing, abusive or unlawful messages through our contact form or other channels;
• try to gain unauthorized access to accounts, systems or data, or test the site for vulnerabilities without permission;
• interfere with the site's operation, including by uploading malicious code or overloading our servers;
• use automated tools to access the site other than standard search engine crawlers that follow our robots rules;
• place fraudulent orders or misuse free trials, discounts or the money-back guarantee, for example by opening repeated accounts.

10. Disclaimers

Recipes, nutrition estimates and cooking guidance are provided for general information. Results depend on your ingredients, equipment and technique. Please read our Disclaimer for important information about food safety, allergens and nutrition.

EXCEPT AS EXPRESSLY STATED IN THESE TERMS, AND TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITE, CONTENT AND MEMBERSHIP ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. We do not promise that the site will be uninterrupted or error-free. Shop products are covered by any warranty described on the product page and by warranties that cannot be excluded under applicable law. Nothing in these Terms limits our money-back guarantee.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CHEESE LLC AND ITS OWNERS, EMPLOYEES AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA OR LOSS OF GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, MEMBERSHIP OR PRODUCTS, EVEN IF WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SITE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED US DOLLARS.

Some states do not allow certain limitations of liability, so some of the above may not apply to you. Nothing in these Terms limits liability for personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law.

12. Indemnity

You agree to defend, indemnify and hold harmless CHEESE LLC and its owners, employees and agents from any claims, losses, liabilities and expenses, including reasonable attorneys' fees, arising from your breach of these Terms, your misuse of the site or our content, or your violation of any law or the rights of a third party.

13. Governing law and venue

These Terms and any dispute arising out of or related to them or to the site are governed by the laws of the State of Florida, without regard to its conflict of laws rules. You and we agree that any legal action must be brought exclusively in the state courts located in Broward County, Florida, or the United States District Court for the Southern District of Florida, and both parties consent to the personal jurisdiction of those courts. Either party may bring an individual claim in small claims court if it qualifies.

Before filing a claim, please contact us at info@recipecheese.com so we can try to resolve the problem informally. Most issues can be sorted out quickly this way.

14. Changes to these Terms

We may update these Terms from time to time. We will post the new version on this page with a new effective date and, for material changes, give notice on the site or by email before they take effect. Changes do not apply retroactively and will not change the price of a membership period you have already paid for. If you do not agree with the updated Terms, you can cancel your membership and stop using the site.

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. These Terms, together with the policies linked above, are the entire agreement between you and us about the site.
